By accessing or using the MySentiMap platform ("Platform", "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.
These Terms constitute a binding legal agreement between you and MySentiMap (ABN 98 716 278 583) ("we", "us", "our"). We may update these Terms from time to time by posting a revised version on this page. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. You must be at least 18 years of age to use this Platform.
MySentiMap is a community-driven market information and entertainment platform focused on ASX-listed mining and resources companies. The Platform provides:
MySentiMap is a community information and entertainment service. It is not a financial services business, stockbroker, financial planner, investment adviser, or financial product issuer. MySentiMap does not hold an Australian Financial Services Licence (AFSL).
This section describes important limitations on how you may use content from this Platform under Australian law. Please read it in full.
All content on MySentiMap — including but not limited to community predictions, sentiment scores, company ratings, price targets, market commentary, and announcements — is provided as general information only. It does not constitute:
Community-submitted predictions and ratings are the personal opinions of individual users, expressed for entertainment and discussion purposes. They are not verified, endorsed, or approved by MySentiMap. They do not take into account any user's personal financial circumstances, objectives, or needs.
Past prediction performance displayed on the Platform is not a reliable indicator of future accuracy or investment outcomes. Investing in securities involves significant risk, including the possible loss of your entire capital. You should always conduct independent research and consult a qualified, licensed financial adviser before making any investment decision.
Market data sourced from ASX and third-party providers may be delayed, incomplete, or subject to errors. MySentiMap does not warrant the accuracy, completeness, or timeliness of any market data displayed on the Platform.
MySentiMap includes a prediction game that allows registered users to submit price targets for ASX-listed securities and other assets. These features are provided solely for entertainment, educational, and social engagement purposes.
By using the prediction features, you acknowledge that your submissions are for game participation purposes only and that no investment decision should be made based on predictions displayed on the Platform.
MySentiMap's prediction and competition features do not constitute gambling under Australian law.
The MySentiMap platform operates a virtual points and rewards system ("Points", "Ticks", "XP"). You should be aware of the following:
MySentiMap's prediction features do not meet the definition of "gambling" or an "interactive gambling service" under the Interactive Gambling Act 2001 (Cth) or any applicable state or territory gambling legislation, as no real money is wagered and no prize of monetary value is awarded. Premium subscriptions are paid for access to Platform features — they are not entry fees for competitions or prediction events.
To access certain features you must register an account. By registering, you agree to:
One account per email address. Each email address may be associated with only one MySentiMap account. Registering multiple accounts to circumvent restrictions, bans, or platform rules is prohibited and may result in all associated accounts being terminated.
Email verification. You must verify your email address before you can make predictions, join competitions, or access interactive features. A verification link is sent to the address provided at registration. If you do not receive it, you may request a new link from the login page.
Username. Your username is chosen at registration and is permanent — it cannot be changed after your account is created. Choose carefully, as it appears on leaderboards and your public profile. Usernames must comply with our content standards at all times.
Account visibility. You may hide your account at any time from Settings → Account. A hidden account is invisible to other users and cannot submit predictions, join competitions, send duel challenges, or play Forecast Tower. Your data, XP, and streak are fully preserved. You may reactivate your account at any time by logging in and visiting Settings → Account — reactivation is immediate.
Account security responsibility: You are solely responsible for the security of your account. MySentiMap is not liable for losses or damages arising from unauthorised access to your account where that access results from your use of a weak password, failure to enable 2FA, sharing of credentials, phishing, loss of 2FA recovery codes, or any other action or omission on your part. Enabling two-factor authentication significantly reduces your risk of unauthorised access and is strongly recommended.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or in breach of applicable law.
By posting predictions, ratings, commentary, or other content on the Platform ("User Content"), you:
MySentiMap does not monitor, verify, or endorse User Content. We reserve the right to remove any User Content that violates these Terms, at our sole discretion and without notice.
You must not use the Platform to:
Third-party links: The Platform may contain links to third-party websites, announcements, or data sources. MySentiMap does not endorse, monitor, or control third-party content and is not responsible for it. Your access to external sites is governed by their own terms and privacy policies.
Violations may result in immediate account termination, removal of content, and referral to relevant authorities including ASIC, ACCC, or law enforcement.
The MySentiMap name, logo, platform design, proprietary scoring systems, and software are owned by MySentiMap and protected by Australian intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Platform without our prior written consent.
Market data: Real-time and historical market data is sourced from third-party providers including Yahoo Finance, Twelve Data, and Financial Modeling Prep under licence. This data remains subject to those providers' intellectual property rights and terms of use. MySentiMap makes no warranty as to the accuracy, completeness, or timeliness of market data, and you should independently verify any data before making any decision. Attribution: data powered by Twelve Data and Yahoo Finance.
Beta features: Certain Platform features — including the Forecast Tower, the Tipping Competition, and new game modes — are provided in an early-access or beta state. Beta features may be modified, discontinued, or result in loss of progress or virtual items without liability. We will provide at least 14 days' notice before removing a beta feature where practicable.
Subscriptions. Certain features require a paid subscription (Solo or Premium). By subscribing you agree to pay all applicable fees, authorise recurring billing, and provide accurate payment information. Subscription fees are charged in Australian Dollars (AUD) inclusive of GST where applicable.
Cancellation. You may cancel your subscription at any time through your account Settings. Cancellation takes effect at the end of the current billing period; access to premium features continues until that date. You will not be charged for subsequent billing periods.

Nothing in this policy limits your rights under the Australian Consumer Law or, where applicable, the consumer protection laws of your country of residence.
MySentiMap operates a commercial data API ("Partner API") that provides authorised third-party businesses ("API Partners") with access to aggregated, anonymised community sentiment and prediction data. By using the Platform, you acknowledge and agree that:
To the maximum extent permitted by applicable law, MySentiMap provides the Platform on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, including but not limited to:
Nothing in these Terms excludes consumer guarantees under the Australian Consumer Law that cannot be lawfully excluded.
To the maximum extent permitted by law, MySentiMap and its officers, employees, and contractors are not liable for:
Where liability cannot be excluded by law, our total aggregate liability for any claim is limited to the greater of: (a) the fees you paid to us in the 3 months preceding the event giving rise to the claim; or (b) AUD $100.
Nothing in these Terms excludes or limits liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded under the Australian Consumer Law or other applicable legislation.
You agree to indemnify and hold harmless MySentiMap, its officers, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Platform in violation of these Terms; (b) your User Content; (c) your violation of any applicable law; or (d) your infringement of any third-party right.
By you. You may pause your participation at any time by hiding your account from Settings → Account. Hiding is reversible — your data and subscription remain intact and you may reactivate immediately. Permanent account deletion is not currently offered as a self-service feature; if you require full deletion of your personal data, please contact hello@mysentimap.com and we will process your request in accordance with our Privacy Policy and applicable law.
By us. We may suspend or terminate your access to the Platform at any time, with or without notice, for any breach of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 3, 5, 9, 11, 12, 13, and 16) shall continue in full force.
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision is severable and does not affect the validity or enforceability of the remaining provisions.
Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
Force Majeure: We are not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, third-party service failures, or pandemics.
Entire Agreement: These Terms, together with our Privacy Policy and (for API Partners) the separate Data API & Partner Programme Terms, constitute the entire agreement between you and MySentiMap in relation to the Platform and supersede all prior agreements, representations, and understandings.
Accessibility: MySentiMap is committed to making the Platform accessible to users with disabilities. We aim for WCAG 2.1 Level AA compliance. If you experience any accessibility barrier, please contact hello@mysentimap.com and we will endeavour to accommodate your needs or provide an accessible alternative.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations at any time without notice in connection with a merger, acquisition, or business transfer.
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising under these Terms. This choice of law does not limit any rights you hold under the mandatory consumer protection laws of your country of residence.
Before initiating any legal proceedings, you agree to first contact us at hello@mysentimap.com to attempt to resolve the dispute informally. We will endeavour to respond within 14 business days.

US dispute resolution: If informal resolution fails, US users may contact the Federal Trade Commission (FTC) or the consumer protection division of their state Attorney General's office.
No US Securities Licences Held. MySentiMap is not registered with the US Securities and Exchange Commission (SEC) as an investment adviser and is not a member of the Financial Industry Regulatory Authority (FINRA). Nothing on this Platform constitutes securities advice, investment advice, or a recommendation regulated by the SEC, FINRA, or any US state securities regulator.
State Blue-Sky Laws. Community predictions and sentiment data are provided for entertainment purposes only and do not constitute an offer, solicitation, or recommendation of any security in any US state. MySentiMap does not hold any state-level securities licence or investment adviser registration. US users are responsible for ensuring their use of this Platform complies with the securities laws of their state of residence.
UIGEA (Unlawful Internet Gambling Enforcement Act). MySentiMap's prediction features do not involve wagering, entry fees, or prizes of monetary value. No financial transactions related to predictions are processed through this Platform. The Platform's features are not "unlawful Internet gambling" as defined under the UIGEA.
US Consumer Rights Preserved. This choice of Western Australian governing law does not limit any rights you hold under US federal consumer protection law (including the Federal Trade Commission Act) or the consumer protection laws of your state of residence. To the extent US law grants you greater protections than these Terms, those protections apply.
California Residents (CCPA). If you are a California resident, you have the right to: (a) know what personal information is collected about you; (b) request deletion of your personal information; (c) opt out of any sale of personal information. We do not sell personal information. Aggregated, anonymised sentiment data shared with API Partners is not a "sale" under the California Consumer Privacy Act (CCPA). If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, the General Data Protection Regulation (GDPR) or equivalent local law applies to the processing of your personal data.
Lawful Bases for Processing. We process your personal data on the following lawful bases:
International Data Transfers. Your personal data may be transferred to and stored in countries outside the EEA (including Australia and the United States), where our service providers operate. Such transfers are protected by Standard Contractual Clauses (SCCs) approved by the European Commission, or equivalent safeguards, as applicable. Our key processors and their transfer mechanisms are listed in our Privacy Policy.
Your GDPR Rights. In addition to the rights listed in our Privacy Policy, EEA/UK users have the right to: (a) data portability — receive your personal data in a machine-readable format (Art. 20); (b) object to processing based on legitimate interests (Art. 21); (c) restrict processing in certain circumstances (Art. 18); (d) lodge a complaint with your national Data Protection Authority (DPA).
